Metrifox Privacy Policy

At METRIFOX PLATFORM INC. (“Metrifox”, “We”, “Us” or “Our”), We value your privacy and are committed to protecting your personal information. This Privacy Policy (“Policy”) describes how we collect, use, share and otherwise process your personal information when you interact with our platform and services, including the choices and rights available with respect to Your personal information.

This Policy applies to all customers and end customers of our products and services, visitors of https://app.metrifox.com/ and individuals (“You’’, or “Your’’) who engage with Us or We engage with, whereby We control or determine the means and purposes of processing your personal information. Such engagement includes but is not limited to using our products and services, recruitment purposes, and any other engagement with Us relating to sales, marketing and research purposes, including when we engage with our partners and service providers. It applies to personal information that We may either collect directly from You or from third parties, in certain cases. We comply with the California Privacy Rights Act (CPRA), Delaware Personal Data Privacy Act (DPDPA), UK General Data Protection Regulation and EU General Data Protection Regulation (GDPR), as applicable.

Depending on who You are and how We are engaging with You, Metrifox may collect information including but not limited to: Account and Contact Information: Name, email address, phone number, company name, identification number, job title, location data, position, area of work, Educational qualifications, work experience, skills, employment history, remuneration, CV/resume, insurance information, health information, credit references, background verification details and results, criminal history for recruitment purposes. Authentication Data: User IDs, hashed passwords, API keys, and login activity. Usage Information: Data on how you interact with our services, such as event tokens, API calls, usage logs, entitlements, and subscription activity, browsing history, search history, and information regarding Your interaction with an internet website or use of a website, application or advertisement, information from analytics services. Device and Technical Data: IP address, operating system, device identifiers, browser identifier, internet service provider, date/time stamp, clickstream data, geolocation data, cookies, beacons, pixel tags, log files, etc. Billing and Payment Information: Payment methods (limited to necessary billing information), transaction history, billing addresses and other financial information. Other personal information which You may provide Us or We may collect about You from You or third parties to engage with You.

Why We Collect Such Information And How It Is Used

Metrifox may use Your personal information for the following purposes: To Provide, Operate and Improve Our Services: This includes delivering our products and services, account setup, managing your account, ensuring the availability, integrity, and security of our offerings, processing payments, maintaining KYC records, user authentication, usage tracking, billing, subscription management, and technical support. We also use your data to monitor performance, prevent misuse, provide analytics and reports, track renewals, assess your needs, improve user experience, develop new products, and enhance our overall services and operations. To process registrations and complete transactions: This involves handling your personal information in connection with events, webinars, contests, blogs, community forums, and other programs you register or sign up for. It also includes processing related payments, communicating relevant details to you, facilitating your participation, and completing any associated transactions on your behalf. For business and research purposes: This includes reaching out for and conducting surveys, setting up interviews, soliciting feedback, analyzing usage and behavior patterns, learning preferences, and sending incentives. To Communicate with You: We may use your information to respond to your questions, comments, and other requests for customer support, security alerts, or information about potential or future services. To market Our services: We may use your information to promote our services, which includes notifying you about offers and services that may interest you, tailoring and personalizing content, advertisements, and promotional offers through targeting and retargeting strategies. It also involves conducting market research, developing and promoting new products and services, measuring interest in our offerings, using your data for any other purposes disclosed when you provided it, and as otherwise permitted with your consent. To Ensure Legal Compliance: We may use your information to comply with legal obligations, including for business accounting and tax purposes such as in relation to record-keeping, compliance, disputes, and filings.

We determine the appropriate retention period for personal information on the basis of the amount, nature, and sensitivity of the personal information being processed, the potential risk of harm from unauthorized use or disclosure of the personal information, whether We can achieve the purposes of the processing through other means, and any applicable legal requirements. For example:
  • Account and subscription data: retained for the duration of the account and for a limited period after account termination.

Metrifox may share your personal information with the following entities or in certain situations as follows: Partners and affiliated companies: We disclose your information as is necessary for us to provide you with our products and services as well as with other business needs and purposes. Auditors, accountants, lawyers and other professional advisers: We disclose your information so they can assist us in compliance with accounting and other business requirements, advise on various legal aspects, prevent violation of law and ensure compliance with the law. Third-party service providers: We may use third-party service providers to process your information to help us with our business activities such as marketing, performance monitoring, product implementation and integrations, recruitment, etc. Regulators, courts, banks or competent authorities: to comply with applicable laws, regulations and rules (including, without limitation, federal, state or local laws), and requests of law enforcement, regulatory and other governmental agencies or if required to do so by court order, as well as for internal compliance procedures and to protect the safety, security, and integrity of Metrifox, our services, customers, employees, property, and the public. Investors and Financial Institutions: We may disclose Your information to potential investors if We are involved in any merger, acquisitions, asset purchase or corporate restructuring, to current investors as part of reporting, and to financial institutions in case We seek any financial assistance or as part of any KYC requirements.

International Data Transfers

We are headquartered in the United States. When you use our services from the European Economic Area (EEA), the United Kingdom (UK), or Switzerland, your personal data will be transferred to and processed in the United States. We ensure that your data is treated securely and in accordance with this Privacy Policy and applicable data protection laws (GDPR), by relying on the following legal frameworks: EU-US Data Privacy Framework (DPF): We rely on the EU-US Data Privacy Framework (DPF) and Standard Contractual Clauses (SCCs) approved by the European Commission to ensure your data receives adequate protection. This applies to transfers to our cloud infrastructure providers (AWS), as well as our payment processors and communication service providers, all of whom participate in the EU-US Data Privacy Framework and are certified under the DPF, which has been determined by the European Commission to provide an adequate level of protection for personal data. Standard Contractual Clauses (SCCs): In cases where the DPF does not apply (such as for transfers from the UK or Switzerland), or as a fallback measure, we rely on the European Commission’s Standard Contractual Clauses (SCCs) embedded in our Data Processing Addendum (DPA) with our hosting providers. We also implement reasonable technical and organizational measures to protect your personal information when it is transferred internationally. Where the EU General Data Protection Regulation (GDPR) or UK GDPR applies, we process your personal information only where we have a lawful basis to do so. These legal bases include:
  • Contractual necessity: where processing is required to provide our products and services, manage user accounts, process payments, and fulfill our contractual obligations to you.
  • Legitimate interests: where processing is necessary for purposes such as service improvement, analytics, fraud prevention, security monitoring, customer support, business research, and internal reporting, provided such interests are not overridden by your rights and freedom.
  • Consent: where required by law, including for marketing communications, non-essential cookies, and similar technologies. You may withdraw your consent at any time.
  • Legal obligation: where processing is necessary to comply with applicable legal, regulatory, accounting, or tax obligations, or lawful requests by public authorities.

Please include details of the specific right you wish to exercise, the relevant personal information involved (if known), your location, and where applicable, the legal basis under which you are asserting the right. In some cases, we may request additional information to verify your identity or to better understand and process your request. We will review and respond to your request within the timeframe required by applicable law. Depending on the nature and complexity of your request, and where permitted under applicable regulations, we may need more time or may be unable to fulfill your request. Change Of Purpose

Our products and services are not intended for use by children, and we do not knowingly collect personal information from or about individuals under the age of 16 (or the age of digital consent applicable in their jurisdiction). If you are under 16, please do not submit any information to us unless you have the involvement and consent of a parent or guardian. Should we become aware that a child’s information has been collected without appropriate consent, we reserve the right to delete such information.

Interactions With Our AI Agent

When you interact with Foxi, our AI Agent, we collect and process:
  • The messages you send to the agent
  • The agent’s responses
  • Metadata about the interaction (timestamp, user account, actions taken)
  • The data retrieved from your account to fulfill your requests
We use this data to operate and improve the service, including debugging issues, monitoring quality and safety, improving agent performance, providing customer support when you request it, and analyzing aggregate usage patterns to guide product development. Access to agent conversations is strictly role-based and privileged. We do not make agent conversations broadly available within our organization, and we do not use them for marketing or sales targeting. Our agent is powered by Anthropic, which processes your messages to generate responses. Their handling of this data is governed by their own terms, available here. We have a data processing agreement in place that restricts their use of your data.
